1.1. These terms of use apply to the use of TADAAM Captive Portal, the service that allows you to connect to the internet via certain public wireless ('WiFi') networks (the "Service").
1.2. By using the Service, you unequivocally agree to the applicability and content of these terms of use and undertake to comply with them.
1.3. TADAAM's general terms and conditions and the Privacy Policy also apply to the Service, insofar as they are not departed from below. You are deemed to have taken note of these documents and to have accepted them. If this is not the case, you may not continue to use the Service. You can consult TADAAM's general terms and conditions at any time at https://www.tadaam.be/en/terms-and-conditions. The Privacy Policy can also be found at https://www.tadaam.be/en/privacy-policy. Where TADAAM's general terms and conditions or the Privacy Policy refer to the term 'Customer', this term must – insofar as not incompatible – be interpreted as also referring to the term 'Visitor'.
1.4. TADAAM reserves the right to amend the terms of use at any time. Visitors will be informed of changes each time they make new use of the Service.
(a) The Service is available to users to whom TADAAM has granted access to use it (the "Visitors").
(b) The Service is provided on an "as is" basis, without any guarantee of availability, speed or error-free operation. You expressly acknowledge that neither TADAAM nor the suppliers or designers of the content of the Service can provide any guarantee concerning the lawfulness, quality, functionality, absence of defects or contaminating material (including viruses, "worms", "trojan horses", "logic bombs" and the like) or availability of the Service or of the content of the Service. Taking into account, among other things, the existing technical limitations, the novelty of the technologies used and the multitude of external (potentially) influencing factors, TADAAM cannot, among other things, give any guarantee that the Service will always be accessible and that there will be no interruptions or errors in the Service.
(a) You will be granted access to the Service if you (i) enter a valid email address, and (ii) accept these terms of use.
(b) TADAAM grants you a temporary, non-exclusive and non-transferable right to use the Service. Any other use, whether for payment or not, is prohibited. You are therefore not entitled to transmit, commercialise, make accessible to the public or publicly communicate, download in whole or in part, copy or otherwise reproduce the Service, or any part thereof (including the content provided), in any way and for any purpose whatsoever.
(c) You undertake not to use the Service in breach of public order or morality, or for fraudulent or unlawful purposes. You further undertake to make normal use of the Service and to refrain from any activity that is considered unacceptable, including (but not limited to) the spreading of viruses or malware, hacking or fraudulent activities, the excessive sending of spam emails or the collection of personal data of third parties and the sending or exchanging of illegal, obscene, racist, offensive or content protected by intellectual property rights, or the sending of a high volume of traffic that impairs the quality of the Service.
(d) If you commit a serious and/or repeated breach of your obligations under these terms of use, TADAAM may suspend the provision of the Service by means of a simple written notification until you comply with all your obligations, or terminate the Service automatically, by operation of law and without prior notice of default, without notice or compensation.
(a) You undertake to use only suitable and properly functioning equipment and software for the Service. As soon as you notice, or should reasonably notice, that the equipment/software used by you is not suitable for connection to the Service, does not function properly or hinders or disrupts the use or operation of the Service or the TADAAM network, you must cease your use of the equipment. Adjustments to the configuration of your equipment and/or software are always carried out at your own risk.
(b) In order to facilitate the provision of the Service, it may be necessary to install certain programs (e.g. cookies) on your equipment. By using the Service, you are informed of this and agree that TADAAM installs such programs.
(a) Through your use of the Service, your personal data will be included in TADAAM's files. TADAAM is the data controller for the processing of your personal data in the context of the Service. These data will be processed in accordance with the Privacy Policy (see https://www.tadaam.be/en/privacy-policy). The Privacy Policy sets out which rights you have as a data subject with respect to the processing of your personal data.
(b) TADAAM processes the necessary data exclusively for the authentication of Visitors, network security and in order to comply with the legal obligations incumbent on TADAAM.
(c) You may voluntarily consent to receive promotions, news or offers from TADAAM. This consent may be withdrawn at any time via the unsubscribe link provided in the communication or in accordance with the Privacy Policy.
(a) TADAAM cannot be held liable for loss of data, viruses, malware, unauthorised access or other damage caused by your use of the Service.
(b) You are responsible for the use of the Service in accordance with these terms of use. You indemnify TADAAM against liability arising from (i) any unauthorised use of the Service, (ii) any breach of these terms of use, and (iii) any disputes with third parties.
(c) By way of derogation from article 8.3 of TADAAM's general terms and conditions, TADAAM's liability towards the Visitor in all cases in which TADAAM is liable in accordance with the general terms and conditions is limited to a maximum amount of EUR 100 per damage event or series of damage events with the same cause.
